Judge: Writer Must Pay Fox $40,000 for Claiming 'Alien vs. Predator' Stole His Script
Twentieth Century Fox In another sign that Hollywood studios are willing to go to the mat against writers who dare claim to have their ideas stolen, 20th Century Fox has won $40,000 in attorney's fees from a writer who sued the studio in 2009 over Alien vs. Predator. James Muller, who is now claiming insolvency, had alleged hisscript, titledThe Lost Continent, bore striking resemblanceto 2004's Alien vs. Predator. Both screenplays told the story ofa battle between extraterrestrialcreatures, but the surface similarity wasn't very convincing forU.S. District Judge Denny Chin. In an order granting Fox's motion for attorney fees, Judge Chin gives three reasons why Muller's claims were "frivolous and objectively unreasonable." First, the stories were really different. The Lost Continent was about "a government-led expedition to the Antarctic to investigate a mysterious structure below the frozen surface. Second, the alleged similarities were ill-conceived. Muller tried to demonstrate "2000+ similarities" but many of the pairings were found to be not very similar. Third and finally, to the extent there was similarities, Judge Chin found they were unprotectable. Many were stock themes instead of things one can actually copyright -- expression. Fox then went after Muller to send a message to potential plaintiffs. The $40,000 award of attorney's fees continues a recent trend where studios fight back hard. The judge's order on Monday also reveals the amount of billable hours a studio can spend in fighting a copyright infringement claim. According to papers submitted by Fox in the case, its fees were based on 1,230.3 hours worked by its team at Hogan & Hartson and Leopold Petrich & Smith at rates ranging from $165 to $395 per hour. That works out to more than $300,000 to fight a nuisancecase, butFox only requested $150,000 with the "belief that the lesser award (would) adequately serve the statutory goals of compensation and deterrence," which the judge seems to have been open to accepting but for a look at Muller's tax returns. Seeing that the plaintiff really was financially hard-up, the judge settles on $40,000 as an amount that will do the trick of sending a message without ruining the guy financially. 'Hysteria' Trailer Has Maggie Gyllenhaal, Vibrators
We've always had a soft spot for Maggie Gyllenhaal, since her co-starring turn opposite brother Jake in 'Donnie Darko,' through 'Secretary' (ahh, yes, 'Secretary'), through 'SherryBaby' and, of course, 'Crazy Heart.' Her next film is Tanya Wexler's 'Hysteria,' a British romantic comedy about the invention of the vibrator in Victorian England that will unspool at the upcoming Toronto International Film Festival. Gyllenhaal stars opposite Hugh Dancy, Jonathan Pryce, Rupert Everett, Ashley Jensen, Sheridan Smith, Gemma Jones, Felicity Jones and Anna Chancellor. Re-Taking the Pleasure of Dance
I'd a breakthrough! During my last publish I pointed out that dance no more brings me exactly the same pleasure previously. Today, for just one brief moment, I finally re-taken that pleasure.My transition to dance continues to be tough to date, and incredibly humbling. I'm said to be an expert artist, and that i seem like a novice. I have felt that dreaded self-awareness slip in sometimes, and I have certainly appeared as if an idiot. And after nearly two decades of coaching I have needed to start at the start, nearly as if all individuals years were only a figment of my imagination.Today I attended a Theater Dance class (in the beginner level) the very first time in you never know how lengthy. Like a musical theater actor Theater Dance is much like comfort food for my body system- or it was once. And despite the fact that the across-the-flooring were rudimentary, they provided an amazing chance.We went over the floor to "You Cannot Stop the Beat" from Hairspray. It's impossible to attend when dancing to that particular song, is not it? I am recognizing since that feeling of abandon is exactly what I have been missing during my go back to dance. The mixture was incredibly simple, however it went perfectly using the sentiment from the music.When I made all things in the mixture I felt something grasp me. All that warmth and happiness that dance accustomed to bring me came flooding back. I felt as though energy and lightweight were shooting from me in most directions like comets tearing with the sky. TCA: Peter Tolan Drops Pants During Raucous 'Rescue Me' Farewell Panel
Ray Richmond is contributing to Deadline's coverage of TCA. It was supposed to be a sober, nostalgic, reflective visit with Rescue Me writer-producer-star Denis Leary, showrunner Peter Tolan and castmates Steven Pasquale and Callie Thorne as the iconic FX firefighter hour wraps up seven seasons on Sept. 7, four days before the 10th anniversary of 9/11. What it turned into Saturday morning at TCA was the most raucous and entertaining panel of the 12-day event to date, as Leary and Tolan put on a show for critics bleary-eyed from the nonstop coverage that finally wraps Monday. Things started to get crazy about halfway through the 30-minute panel, when Leary observed with his usual manic energy, "You guys have spent, what, three fucking weeks here talking to TV people and now you're fuckin' bored." Tolan then picked up the ball and added, "I'm going to take my pants off." That led into a fresh rant from Leary, who railed: "By the way, USA (Network) is fuckin' raiding Rescue Me. (Steven) Pasquale's shooting a pilot (Over/Under) for them. Callie (Thorne) is starring in a show (Necessary Roughness) for 'em. I'm writing a pilot for 'em." Tolan: "I'm doing very mild janitorial work. ... And working for just a few weeks as (USA programming chief) Jeff Wachtel's fluffer." Shortly thereafter, to help boost the excitement of the festivities, Tolan stood and pulled down his pants to reveal very oddly colored briefs. Much laughter and applause ensued. A critic then tried to ask a serious question: Does Leary fear that his role on Rescue Me is one he will now always be identified with, perhaps to his detriment? Tolan decided to intercept that one: "When you say that Denis will be remembered for this part, I think you're forgetting Operation Dumbo Drop." The room roared. Earlier in the panel, the men proved far more serious and reflective, expressing pride at what Rescue Me has been able to accomplish. "It was designed as a show that would keep the idea of what happened on 9/11 alive," Tolan said. "The show wound up being the only piece of popular entertainment to spring from 9/11, the only thing to be accepted and has lasted. And I think the primary reason for that was the humor. It said, this is how we really deal with it and move forward." Leary added that ending the series around the 10th anniversary of 9/11 was sort of "a good time totem. There was a natural feeling of summing up. Plus Peter and I really hated each other by the end and (FX topper) John Landgraf was sick of giving us notes.
